General information and identification

1. The owner and administrator of the website www.mazzoni.pl (hereinafter the “Website”) is Tomasz Duczmal, conducting business activity under the business name MAZZONI Tomasz Duczmal, with its registered office and address for service at: ul. Jarosława Stryczyńskiego 2a, 63- 50 Sulmierzyce, Tax Identification Number (NIP): 6211242051, National Official Business Register number (REGON): 300016167, e-mail address: [email protected] (hereinafter “Mazzoni” or the “Service Provider”).

2. This document lays down the rules for using the Website. By using the Website, the user accepts the provisions of this legal notice.

Nature of the Website

1. The Website is of an informational and presentational nature. In particular, it is intended to:

  • provide information about the Mazzoni company,
  • present its offer and completed projects,
  • enable contact with Mazzoni (e.g. via contact details or a contact form).

2. The Website does not constitute an online shop within the meaning of consumer law. The conclusion of contracts (e.g. for services offered by Mazzoni) takes place individually, by means of direct contact with Mazzoni (e.g. by telephone, by e-mail or in person), on terms agreed separately.

3. The Website may contain links to an external online shop operated by Mazzoni or by cooperating entities. Contracts for the sale of products are concluded exclusively on the target websites, in accordance with the terms and conditions applicable in the given shop

Rules for using the Website

1. The user undertakes to use the Website in a manner:

  • compliant with applicable law,
  • consistent with good practices and the principles of social coexistence,
  • not infringing the rights or personal interests of Mazzoni, other users or third parties.

2. In particular, it is prohibited to:

  • take any actions that may disrupt the functioning of the Website or prevent other users from using it,
  • introduce harmful software into Mazzoni’s ICT system (viruses, trojans, “worms”, etc.),
  • attempt to gain unauthorised access to Mazzoni’s IT resources.

3. Any actions by the user that may cause damage to Mazzoni or other users may constitute grounds for pursuing claims for damages.

Provision of services by electronic means

1. The use of the Website constitutes the use of services provided by electronic means within the meaning of the Polish Act of 18 July 2002 on the provision of services by electronic means.

2. The services provided electronically by Mazzoni via the Website include in particular:

  • making informational content available on the Website,
  • enabling the use of a contact form (if available)

3. In order to use the Website, the user must meet the following minimum technical requirements:

  • a device with access to the Internet,
  • an up-to-date version of a popular web browser (e.g. Chrome, Firefox, Edge, Safari) with JavaScript and cookies enabled,
  • for the use of certain functions – software enabling the opening of files in PDF format.

4. The user may discontinue the use of the Website and of the services provided electronically at any time by closing the browser window or ceasing to visit the Website. This does not entail any fees or obligations for the user.

Intellectual property

1. All content placed on the Website, in particular texts, photographs, graphics, video materials, the layout of the Website, as well as logos, trademarks, trade names and other designations identifying Mazzoni, is protected under copyright and related rights legislation and under industrial property law.

2. The rights to the elements referred to in point 1 belong to Mazzoni or to entities that have granted Mazzoni the relevant licences.

3. Without Mazzoni’s prior explicit consent, it is prohibited to:

  • reproduce, distribute, publish, modify or make publicly available any content from the Website,
  • use trademarks, utility models or designs belonging to Mazzoni for any purpose going beyond permitted use as defined by law.

4. The user’s use of the Website does not result in the acquisition of any intellectual property rights to the content placed on it. The user is only authorised to use such content within the scope resulting from the provisions of law and the functionalities of the Website.

Liability

1. Mazzoni’s objective is to ensure the correct and continuous operation of the Website. However, Mazzoni reserves that:

  • the operation of the Website may be periodically suspended or limited, in particular for technical reasons (e.g. maintenance, updates, failures) or for reasons beyond Mazzoni’s control (e.g. telecommunication outages, actions of third parties),
  • Mazzoni does not guarantee uninterrupted access to the Website or that it will be free of errors.

2. To the fullest extent permitted by applicable law, Mazzoni shall not be liable for any damage arising:

  • from the unavailability of the Website or interruptions in its operation for reasons beyond Mazzoni’s control,
  • from force majeure events,
  • from improper use of the Website by the user, including violations of this legal notice.

3. The Website may contain links to third-party websites. Subject to Articles 12–15 of the Act on the provision of services by electronic means, Mazzoni is not liable for the content published on such websites or for the consequences of users’ use of such websites.

4. If damage is caused to Mazzoni as a result of unlawful or improper use of the Website by a user, Mazzoni may pursue claims against that user to the extent provided for by law.

5. The user shall be liable for any damage resulting from the use of automatic tools (“bots”, “spiders”, etc.) in a manner that causes an excessive load on the Website or on Mazzoni’s systems, or that infringes legal provisions or the principles of social coexistence.

Provisions concerning consumers and jurisdiction

1. Nothing in this legal notice is intended to exclude or limit consumer rights arising from mandatory provisions of law.

2. Any disputes arising from the use of the Website by a user who is a consumer:

  • may be resolved by a court having local jurisdiction in accordance with generally applicable provisions (in particular the court having jurisdiction over the consumer’s place of residence), or
  • at the consumer’s choice – by a court having jurisdiction over Mazzoni’s registered office.

3. In the case of users who are not consumers, any disputes arising from the use of the Website shall be resolved by a common court having jurisdiction over Mazzoni’s registered office.

Amendments to the legal notice

1. Mazzoni reserves the right to amend this legal notice at any time, in particular in the event of:

  • changes in legal provisions,
  • changes in the functionalities of the Website,
  • the introduction of new services provided by electronic means.

2. The amended legal notice will be published on the Website with a new update date and shall apply to the use of the Website from the moment of its publication.
